!important;">我国关于夫妻共同债务的法律制度经过了一个由简至繁，逐渐完善的过程。最初我国婚姻法对夫妻共同债务的范围没有做出明确规定，只规定了在夫妻对婚姻关系存续期间所得的财产约定归各自所有且第三人知道该约定的情况下，夫或妻一方对外所负的债务不属于夫妻共同债务，以夫或妻一方个人所有的财产清偿。随着社会经济的迅速发展，夫妻债务的情况也日益复杂，原有的法律规定与现实状况脱节，无法满足现实的司法需求。</p><p style="max-width: 100%;min-height: 1em;text-indent: 2em;box-sizing: border-box !important;overflow-wrap: break-word !important;">为了平衡债权人与作为债务人的夫妻之间的关系，2003年最高人民法院公布<strong style="max-width: 100%;box-sizing: border-box !important;overflow-wrap: break-word !important;">《最高人民法院关于适用<中华人民共和国婚姻法>若干问题的解释（二）》</strong>，规定婚姻关系存续期间夫妻一方以个人名义所负债务应当按夫妻共同债务处理。除非夫妻一方能够证明债权人与债务人明确约定为个人债务，或者能够证明第三人知道夫妻对婚姻关系存续期间所得的财产约定归各自所有。</p><p style="max-width: 100%;min-height:
